Minutes of the monthly audit meeting of the Town Board of the
Town of Olive held Monday, June 5, 2000 7:30 pm at the Town
Meeting Hall in Shokan, NY.
Members present:
Berndt Leifeld, Supervisor
Cindy Johansen, Council Member
Helen Chase, Council Member
Bruce La Monda, Council Member
Linda Burkhardt, Council Member

Supervisor Leifeld stated the Cablevision fees were received
and expressed concern that Rusty Monroe of Telecom Associates has
not fulfilled the promises made prior to entering into contract
with his firm.
Supervisor Leifeld introduced the contract for engineering
services for the swimming pool project. He stated the contract
fee would be $20,000.00 for both Stephen Molmed and Clayton Bisch.
Supervisor Leifeld asked Town Board members if the bids are
received and they come back at $600,000.00 plus for the swimming
pool, what will their response be. He noted that Mr. Molmed has
the costs broken down with payments to see the pool through
construction; therefore, if there is no construction then there
will be no payments. Discussion occurred on the proposed
contract.
Supervisor Leifeld stated grant applications from the Department
of Parks and Historic Restoration are now available and asked the
board members if they wish to pursue another grant. Council
Member Johansen asked the Town Board how they originally chose La
Barge Associates and stated the board should consider looking
into someone else besides La Barge to write the grants since they
are engineers and not grant writers. Council Member La Monda
stated since the grant has already been prepared by La Barge the
board should ask what they would charge the town since it is
already written. Council Member Chase stated La Barge was
charging us money but was using someone else's grant. Supervisor
Leifeld stated La Barge was quick to respond to the town last
year and doesn't fault their company for not receiving the grant
since NY State chose to give all the money to themselves.
Council Member Chase stated she spent a lot of time seeing that
errors were corrected in the proposed wireless law and with the
attorney's changes there are now more errors. She noted that
"commercial impracticability" was taken out as a
definition; however, it was used throughout the document. Council
Member Burkhardt asked if Council Member Chase is suggesting they
cancel the public hearing noting that if anything is changed then
they can't have the public hearing. Supervisor Leifeld suggested
that after the meeting Council Member Chase meet with the
attorney to clean up the document. Council Member Chase stated
that consultant Dick Comi missed things in the original draft and
even after talking to the attorney still has no idea what a law
should look like.
Council Member Burkhardt stated if it has been reviewed and
accepted by our attorney then that is what we are paying him for.
Council Member Chase stated it is not a clean copy. Supervisor
Leifeld reiterated they should discuss this after the public
hearing.
On a Leifeld/Johansen motion the Town Board approved proceeding
with the public hearing on the proposed wireless law as presented
by Attorney Peter Graham. Roll vote: Johansen, yes; Chase,
abstained; La Monda, yes; Burkhardt, yes; and Leifeld, yes.
Supervisor Leifeld stated the Town Board will discuss changes
that are suggested after the meeting and if they are minor and do
not affect the implementing of the law then they will be done.
Gene Sorbellini stated the Health Department was present to
inspect the park for summer recreation, bus transportation costs
have not increased, and asked the Town Board whether or not fees
will again be charged for the summer recreation program.
On a Leifeld/Burkhardt motion and unanimous approval the Town
Board adjourned to executive session for the purpose of the
discussing union negotiations at 8:30 pm.
The Town Board reconvened the regular meeting at 8:45 pm at which
time they adjourned on a Leifeld/Burkhardt motion.
