Minutes of the monthly audit meeting of the Town Board of the Town of Olive held Monday, June 2, 2003, 7:30 pm at the Town Meeting Hall in Shokan, NY.

Members Present:                  Berndt Leifeld, Supervisor

                                                Cindy Johansen, Council Member

                                                Helen Chase, Council Member

                                                Bruce La Monda, Council Member

Member Absent:                      Linda Burkhardt, Council Member

Others Present:                      Everett Cook, ZBA Member

In the absence of the Town Clerk notes for the meeting were submitted to the Town Clerk for preparation of the minutes.

The Town Board audited the bills for the month of May and reviewed items for the agenda for the June 3rd meeting.

The Town Board discussed current litigations.

All business pertinent having been discussed the Town Board adjourned at 8:30 pm on a Leifeld/La Monda motion.

Minutes of the regular monthly meeting of the Town Board of the Town of Olive held Tuesday, June 3, 2003, 7:30 pm at the Town Meeting Hall in Shokan, NY.

On a Chase/Johansen motion the Town Board unanimously approved the minutes of the previous months meetings as submitted by the Town Clerk.

The following correspondence was read and filed:

#42-03

Ed Pine, Sr. Engineer with Ulster County Department of Highways and Bridges, stated effective June 9, 2003, Lawrence Bridge, County Bridge #31 over the Mettacahonts Creek off of Sahler Mill Road, will be closed for required replacement work.  It was noted by Supervisor Leifeld that this bridge is not in the Town of Olive.

Mike Grehl, Transportation Manager for Onteora Central Schools, extended his thanks to the Town of Olive Highway Department and the Highway Superintendent for another successful season of dealing with the winter weather in the Onteora district.

#44-03

The NYS DOT stated a multi-year project to inventory and develop a management plan for the states historic bridges has been completed.  They noted that Minar Hyatt Bridge over the Esopus Creek and the Route 28A Ashokan Spillway Bridge are both in Olive and are on the inventory list.   The Town Board stated that the Ashokan Spillway Bridge is not in the Town of Olive.  Tree McIlhenny stated that if the town designates the Coldbrook Bridge a historic bridge then funds could be available for refurbishing it.

On a La Monda/Johansen motion the Town Board unanimously approved payment of the following audited bills:  Highway Vouchers #158-#195, $59,937.75; General Fund Prepaid Voucher #213, $222.00; General Fund Vouchers #214-#267, $22,976.60; and Special Lighting Voucher #5, $35.49.

Supervisor Leifeld stated our insurance company is trying to renege on the coverage of the towns insurance regarding the Masterpage suit. He stated that halfway through paying the bills our main insurance company for liability has decided they dont want to pay anymore He entered into the record correspondence #45-03 from Marshall & Sterling Insurance stating they are in the process of appealing this matter with the insurance company.

Supervisor Leifeld noted the April monthly income as $14,421.30 and interest received through April as $5,346.22.

FIRST AID liaison Council Member Chase noted the open house two weeks ago was not that well attended but for those who were there, it was enjoyable.  She thanked the Town Board for donating the platters.

PARKS & RECREATION liaison Council Member Chase submitted report #46-03 stating the committees May 21st meeting was almost totally devoted to issues regarding the swimming pool and its usage during the summer rec program.   She stated the family membership fees will increase to $50.00 per family, $35.00 for singles, and $2.00 per individual for day use.   There will be sessions for water yoga, aqua aerobics, infant and toddler swim lessons, and adult swim.  She stated the Rec Committee would like to request a handicapped lift be installed at the pool.  She noted adults are needed to help with Little League, T-Ball, and soccer. 

FIRE DEPARTMENT report #47-03 showed a total of 47 responses by the five companies during the month of May.

POLICE Commissioner La Monda stated range training will be held at the Ulster Range and today was the bicycle safety course at Bennett School with 48 children participating.   On a La Monda/Burkhardt motion the Town Board requested a letter be sent to Police Office B.J. Leifeld commending him for doing an excellent job with this program. 

HIGHWAY Committee liaison Council Member Johansen issued May report #48-03 noting Jim Fugel is attending the annual Highway Superintendents school at Cornell, the 1-ton Ford truck has arrived, repair of the vacuum truck has been completed, paving has been done around the pool in West Shokan, attempts are being made to locate the well at Davis Park, FEMA funds have been received for the January 3-4, 2003 storm, and bridge work on Route 213 in Olivebridge will not begin until 2004.

TOWN CLERK Rozzelle stated June 2nd was the last day for collecting taxes locally.   All tax collection books will be turned over to the County Treasurer on June 17th.

On a Leifeld/La Monda motion the Town Board unanimously appointed George Burns as Dog Control Officer.

On a Leifeld/Johansen motion the Town Board unanimously approved the following pool rates:  $2.00 per person for day use, $35.00 per single adult membership, and $50.00 per family membership.

On a Leifeld/La Monda motion the Town Board made the following budget adjustments:  $282.00 from DA9060.8 (Hospitalization) to DA9050.8 (Unemployment Insurance) and recognized revenues in FEMA account DA4960 $36,236.85 and increased budget appropriations DA5142.4 (Snow Removal) $36,236.85.

On a Leifeld/Chase motion the Town Board recognized revenues for Park Grant Account A3089 of $11,500 and increased budget appropriations A7110.4 (Parks) by $11,500.00

On a Leifeld/La Monda motion the Town Board approved the following fund transfers: $245.00 from A1355.4 (Assessor-contractual) to A1355.2 (Assessor-equipment) and $10,000.00 from A1990.4 (Contingency) to A1420.4 (Attorney).

Due to Government Accounts Standards Board requirements, on a Leifeld/La Monda the Town Board closed Park Reservation Checking Account in the Trust & Agency Fund and transferred the $7,501.57 plus interest accrued and not paid to the General Fund. 

On a Leifeld/La Monda motion the Town Board transferred $15,731.33 plus interest accrued and not paid from the Recreation Trust Account in the Trust and Agency Fund to the General Fund with a reserved fund balance.

Council Member Johansen stated she would like to publicly make it known that the Olive Town Board has not supported or acted on any issue regarding the large project in the Town of Shandaken.  Supervisor Leifeld stated the Watershed Coalition passed a resolution supporting home rule rights with the Coalition not being in favor of or against anything regarding the Shandaken project.  He stated the resolution passed by the Watershed Coalition simply had to do with home rule in local municipalities evaluating environmental impacts of projects in their towns.     He stated they supported the Town of Shandaken only on the issue of home rule regarding Shandaken wanting to be a part of the environmental impact statement.      Council Member La Monda stated the Watershed Coalition resolution addressed towns having funds provided by project applicants so the town can participate in the SEQRA process.  He stated the main purpose of the resolution passed at the coalition was to include towns in this process to save the taxpayers dollars.  Council Member La Monda stated the Town of Olive would be in the same mess here if a major project was introduced where the DEC becomes lead agency.
