Minutes of the monthly audit meeting of the Town Board of the Town of Olive held Monday, October 4, 2004, 7:30 pm at the Town Meeting Hall in Shokan.

The Town Board audited the bills for the month of September and set the agenda for the October 5th meeting.
Town Clerk Rozzelle presented Town Board members with copies of the 2005 Tentative Budget.
Discussion occurred regarding whether or not the August 19th meeting of the Onteora School Board was properly advertised. It was noted the August 17th meeting was the regularly scheduled meeting; however, having a quorum but not having a majority the School Board opted to postpone the August 17th meeting until the 19th. It was stated that Council Member La Monda would contact a local attorney regarding investigating this issue.
Discussion occurred on the Onteora School District’s being able to do a district wide evaluation of properties and not opting to utilize the town’s assessment rolls.
All business pertinent having been discussed the Town Board adjourned at 8:35 pm on a Leifeld/La Monda motion.

On a Burkhardt/Chase motion the Town Board approved the
minutes of the September
meetings as submitted by the Town Clerk.
The following correspondence was read and filed:
#100-04
George Koury of Krumville urges the Town Board to do whatever
it takes to secede from the Onteora School District and to sue the Onteora
School, the school board, as well as every individual member of the board who
voted for the current tax increase.
#101-04
Elaine and Francis Ralston stated they would be willing to
take an active part if the Town Board would secede from the Onteora School
District and sue the Onteora School Board.
Supervisor Leifeld stated for the past couple of weeks the
town has been inundated with phone calls expressing these same comments. He
noted he has spoken with the President of the NYS School Administrators and have
asked him to find someone to come down from the state to explain this process to
us. He stated the town would like to find out what it would take to secede from
the district

On a La Monda/Rank motion the Town Board unanimously approved
the following persons as members of the Olive Fire Department: David Croswell of
Shokan, Warren Bundy of Shokan, and Michael Davis of Olivebridge.
On a Chase/La Monda motion the Town Board approved payment of
the following audited bills: Highway Vouchers #284-#306, $15,304.36; General
Fund Vouchers #495-#568, $36,307.86; and Special Lighting Voucher #9, $34.30.
Under Old Business: Supervisor Leifeld stated the UC
legislature passed Resolution
#276 (#103-04) which is in opposition to the state taking
speeding ticket money from the local courts. On a Leifeld/Rank motion the Town
Board requested a letter of support for this resolution sent to the Ulster
County Legislature.
Supervisor Leifeld stated that one of the changes the town
has made is to service the town police cars and small trucks in house. He stated
the reason the town hasn’t done this in the past is due to the hydraulic lift
not being acceptable for smaller vehicles. He stated that Highway Superintendent
Fugel has received the following price quotes for an inground hydraulic electric
lift:

On a Leifeld/Rank motion the Town Board unanimously approved
empowering the Superintendent of Highways to proceed with this purchase from Ira
Conklin in the amount of $7,375.00.
Supervisor Leifeld noted the August monthly income as
$33,225.63 and interest received through August as $11,040.35.
Supervisor Leifeld stated that Police Commissioner Bob
Schanck requested being on the agenda. Mr. Schanck stated he had received a
letter at the end of July from the Ulster County Board of Elections revoking his
privilege to vote in Olive District 5 in Boiceville. He stated on the advice of
his attorney he sent a letter and notarized statement dated August 4, 22004 to
the County Board of Elections. On September 9, 2004, he received a letter
(#104-04) from Ulster County Board of Election Commissioners Harry Castiglione
and Thomas Turco stating there was a split decision between the two
commissioners; therefore, he maintains his voting status in Boiceville. He
stated he would like to continue to serve at the pleasure of the Town Board.
Cindy Johansen submitted documents (#105-04) for the Town
Board to review. She stated that Mr. Schanck currently lists his residence in
Florida through declaring domicile there and noted the Florida Elections
Commission verbally confirmed that Mr. Schanck is listed on Florida voter
registrations since 1999.
Mr. Schanck stated he would like to make a brief response
noting that it is common knowledge that he has multiple residences. He noted he
has not voted anywhere else except the Town of Olive for the past thirty years.
He stated it is not the Town Board’s decision nor is it the decision of the
Olive Republican party to determine where he may vote.
Supervisor Leifeld stated the Town Board said last time that
this issue is going nowhere and the route of going to an attorney should be
pursued by anyone who wants to take it.
The following committee reports were read and filed:
FIRST AID liaison Council Member Chase submitted September
report #106-04 showing the unit responding to eight calls and traveling 182
miles. She stated they are pleased to have three new members join last month and
three new members to be considered this month.
PARKS & RECREATION liaison Council Member Chase issued
September Recreation Committee meeting report #107-04. She noted the committee
would be meeting the third Thursday of the month during October and November.
FIRE DEPARTMENT report #108-04 noted forty-six (46) total
responses for the month of August.
TRANSFER STATION liaison Council Member Burkhardt submitted
August report #109-04 noting revenues of $6,875.00 with 72.69 tons removed at an
expense of $5,088.30. She stated that UCRRA is talking about increasing tipping
fees to the towns noting that if they do raise the fees then the town may be
forced to raise ours.
CABLE TELEVISION liaison Council Member Burkhardt read
letters from Time Warner Cable and stated a rate increase on basic service and
channel changes will be taking effect on October 8th.
POLICE COMMISSIONER La Monda reported on the assists for the
month. He stated a
Car Seat Inspection event was held on September 26th
and over forty fitted helmets were given out at Olive Day to the residents and
nonresidents who participated in the Bike Rodeo. Commissioner Bob Schanck stated
the Police Department also conducts a yearly bicycle safety course for the
fourth grade class at Bennett. Commissioner Schanck stated that over ten car
seats were found defective and replaced noting the Car Seat Inspection was in
conjunction with the Olive Fire Department.
HIGHWAY liaison Council Member Rank submitted report #110-04
noting the department motorpaved Butternut Knolls, cut standing dead trees using
the bucket truck on Upper Boiceville Road, reconstructed the intersection of
Beaverkill Road & Route 28A, blacktopped under the bleachers at Shokan Park,
closed the pool for the season, put a new roof on the main garage building using
the bucket truck to set the trusses, and replaced the front door at the Town
Office Building.
TOWN CLERK Rozzelle noted that local Voter Registration Days
will be held Wed., October 6th 4-8 pm at the Olive Free Library and
Sat., October 9th 2-9 pm at the American Legion Hall. She stated that
Jack Molloy had requested she announce that there will be a Veteran’s Day
Service at the American Legion Hall on November 11th at 11:00 a.m.
Under New Business: On a Leifeld/Chase motion the Town Board
unanimously approved the following budget modifications:
Transfer $12,500.00 from Reserve L Buildings to A1620.4
Buildings
Transfer $2,500.00 from A1990.4 Contingency toA7110.1 Parks
Transfer $5,504.00 from A1990.4 Contingency to A7180.1 Pool
Transfer $2,282.00 from A3120.1 Police to A3120.2 Police
Equipment
Supervisor Leifeld noted the Coalition of Watershed Towns is
now holding elections. Ulster County has two regular candidates; Berndt Leifeld
and Robert Cross, Jr. and two alternate candidates; Bruce La Monda, and James
Dolaway. On a Rank/Burkhardt motion the Town Board unanimously approved
Resolution #12 of 2004 approving the four names on the ballot. Roll vote being:
Rank, yes; Chase, yes; La Monda, yes; Burkhardt, yes; and Leifeld, yes.
Supervisor Leifeld stated that the 2005 tentative budget was
distributed to the Town Board last night. He stated a workshop meeting would be
held October 14th 7:30 pm at the Town Meeting Hall.
Supervisor Leifeld stated he would like the Town Board to
support a letter to the Ulster County Legislature opposing any such move on
enacting the Large Parcel Bill. On a Leifeld/La Monda motion the Town Board
unanimously approved sending said letter. Supervisor Leifield stated he spoke
with Cindy Johnasen and they have taken it upon themselves to send a letter from
their party and even from private citizens to the Ulster County Legislature.
Blake Killin asked if Supervisor Leifeld had heard that Chris
Ward is resigning as NYC DEP Comissioner. Supervisor Leifeld stated he had heard
and no one knows why or who the replacement is.
All business pertinent having been heard the Town Board
adjourned at 8:35 pm on a Leifeld/Burkhardt motion in memory of Judith Joseph
and Herbert Louis Wells. The motion was to include a page in the Town Minute
Book dedicated to Herb Wells.
